Copyright has often been described as the engine of free expression, meaning that copyright is thought to be the primary mechanism that promotes the advancement of knowledge and free speech.� It does this by providing a means by which artists and authors are encouraged to produce still more works.� However, the current bloated copyright regime is no longer really the engine of free expression but has instead become more of a hindrance and an obstruction to free expression It is indeed true that copyright protection is to a certain extent a form of censorship--copyright has gotten so bloated in recent years that it has become perhaps the most pervasive form of censorship present today.� No longer does government act as the primary force of censorship and regulation of speech�it is now large entertainment conglomerates that act to chill speech and to restrict creativity.� Copyrights are often controlled not by individuals but by large media conglomerates.� The result is that highly concentrated copyright industries control vast inventories of copyrighted works, imposing free speech burdens on individual speakers.� Very often, rightsholders are able to use copyright laws to prevent others from criticizing or poking fun at their artistic works.� If they don�t like what you say, they can deny permission or they can destroy you in court with a crushing lawsuit.�� If you want to say something in public that borrows or builds upon a prior work to any extent whatsoever, you may need to beg permission from some large corporation.� Copyright holders are often able to silence another artist�s chosen manner of expressing, receiving, or distributing an idea if the artist tries to use, adapt, or exploit any parts of the rightsholder�s works while conveying that idea. ��Just about every form of borrowing or adaptation of previous works requires an elaborate set of permissions and payments, and a copyright owner can effectively squelch another author�s expression if the rightsholder happens not to like what the new author did with the work they are borrowing from.� This means that authors are often unable to convey their messages in the most effective manner.� Copyright law and practice are often so restrictive that many authors and artists are forced to censor themselves rather than incur the risk of being sued.�� There is a great deal of uncertainty about if or when a particular borrowing or adaptation from existing expression infringes a copyright, and many copyright owners claim far greater copyright protection that is actually called for in the law or what would reasonably be enforced in court.
